Item 6b <br />PUD-96-12, Mike D0miniSSe <br />Application for PUD development plan approval to allow the COnStruction of a 3,540 sq.ft. <br />single-family home with a 1.080 so_.ft. three-car garage on a 2,43 acre site located at 2500 <br />Vineyard Avenue. Zonin2 for the property is PUD (Planned Unit Development ) - RDR <br />(Rural Density ReSidential) District. (SR97: 322) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mayor Tarver wanted to make certain that the condition requiring payment of the pro rata <br />share of Vineyard Corridor infrastructure was worded correctly and that the applicant was aware <br />of the potential costs. <br /> <br /> Mr. Swift stated the wording of the proposed condition read as it did because of the <br />uncertainty of what the actual infrastructure will be and its cost. <br /> <br /> Mr. Pico asked if the applicant objected to the condition. <br /> <br /> Mr. Swift said the applicant agreed with the condition. <br /> <br /> Mr. Roush believed that staff could make a reasonable assumption of the cost of the <br />infrastructure and as part of the agreement, require the applicant to deposit 1/150th of the <br />infrastructure costs. If actual costs were more than that, the City could require an additional <br />payment in the future. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Michael Dominisse, 11389 Betlen Drive, Dublin, indicated he agreed with the staff report <br />and was in agreement with all conditions. <br /> <br /> There was discussion among Council and staff regarding the possible infrastructure, <br />calculation of infrastructure costs and the method of determining the applicant's pro rata share. <br /> <br /> Mr. Dominisse inquired if a bond could be provided rather than a cash payment. He also <br />asked what mechanism would be used to collect his pro rata share. <br /> <br /> Mr. Swift indicated the method of collection would be determined by the City Council <br />at a later date. <br /> <br /> There being no further testimony, the public hearing was closed. <br /> <br />Heasanton CRy Council 11/04/97 <br />Minutes 5 <br /> <br /> <br />
