Ms. Dennis suggested Taubman and Wells Fargo work out an agreement that would have Wells Fargo give up square footage rather than take away from the Mall square footage. The two could work this out among themselves and then bring back an alternate solution that would not only shift who was first in line for doing the improvements but also shift who would take the risk for loss of entitlements. Ms. Ayala asked what incentive Wells Fargo would have to make this kind of commitment. Ms. Dennis said the five year extension. Ms. Michelotti asked for a continuance of this item. Mayor Tarver did not support an extension. Wells Fargo already has a ten year agreement and he would like to see Wells Fargo develop within its development agreement time frame. Ms. Ayala said the suggestion allows both parties to get what they want and gives the City protection until the West Las Positas study is done. She felt it was worth looking at. Mayor Tarver said his motion is tied to the completion of the West Las Positas study. He felt once Council has this information it would be able to make a more intelligent decision. He said the solution and funding for traffic issues needed to be known. Ms. Ayala asked if he was concerned about Canyon Way. Mayor Tarver said he was concerned about Canyon Way. Canyon Way should have been started by now. He felt it was in the Mall' s interest to get the road improved without asking for additional square footage. Ms. Michelotti said the offer was to do more than just the Canyon Way improvements; there is up to $1 million worth of improvements. Ms. Michelotti made a substitute motion to continue the item for one month. Mayor Tarver asked when the West Las Positas study would be finished. Mr. Swift said April 1998. Mayor Tarver said he was willing to change his motion to deny the request pending the completion of the West Las Positas study or a date specific. He would like to get the study done first.
