Mr. Pico asked if this were the case for any other businesses? Why once authorized,
could the business not proceed under its conditional use permit?

Mr. Roush said that could be an option.

Ms. Michelotti asked for staff to explain the "right to sell" versus the "right to carry"
a weapon.

Mr. Roush said this ordinance prohibits the sale of these particular firearms; it does not
prohibit possession: junk guns are typically small and concealable; in order to carry it, a
concealed weapons permit is required.

Mr. Dennis asked if the sale of firearms at the Alameda County Fair grounds would be
subject to Chapter 6.64?

Mr. Roush said yes. Chapter 6.64 could be modified to be more broadly defined. The
whole matter would be referred to the Planning Commission to make recommendations in
regards to the sale of firearms on the Fairground's property or elsewhere throughout the
community.

Mr. Pico asked if an ordinance were adopted allowing the sale of firearms on the
fairgrounds, would it apply to the master show organizer as well. Who would have to comply?

Mr. Roush said anyone who would be engaged in the selling of guns would have to
comply. There may be a way to revise it though so a master permit could be utilized.

Mr. Pico commented that this could be a lengthy process for City staff or the Police
Department to have to go through each year.

Mr. Roush said that is correct.

Mayor Tarver opened the public hearing

Rosiland Wright, 5331 Northway Road, urged the Council to adopt the ordinance.

Nora Sabhlok, 4129 Grant Court, said she is in favor of passing responsible gun
legislation in Pleasanton. As a parent who lives near an elementary school, she was appalled
to learn that weapons/guns were being sold within two blocks of a school. She asked for
enforcement of the zoning ordinance which would prevent this. She supported the ordinance that
would prohibit the sale of "Saturday Night Specials" in Pleasanton.

Pleasanton City Council 07/12/97
Minutes 2
