Mayor Tarver explained everything on the consent calendar had been approved in one <br />motion, except for Item 4h, which was continued. <br /> <br /> Todd Fujinaga, 37317 Termor Blvd, Fremont, and Don Kaplan, 634 Blue Spruce Drive, <br />Danville, 94506, asked for Council's decision on the Bonfare Market to be reconsidered. That <br />decision stated no hard liquor would be sold. The Zoning Ordinance for the City of Pleasanton <br />specifically states that grocery stores/convenience markets require a conditional use permit, but <br />a liquor store does not. He said they applied to put in a Bonfare Market, because the consensus <br />of the community was not to put in a liquor store. He said he would like Council to revisit the <br />issue. <br /> <br /> Mr. Swift commented the original 1978 approval for a supermarket covered 18,000 <br />square foot site within the shopping center. A supermarket conditional use permit was approved <br />on January 10, 1979. Staffs position was the proposed use in this recent instance was for a <br />convenience market and that is different from a supermarket, which was the original use permit. <br />Also the site which is being proposed is not within the same portion of the shopping center as <br />the original market. Staff recognizes use permits run with the land, however staff has always <br />treated use permits that are within an overall center as discreet as to the location within the <br />center that it occupies. Based on these two reasons, staff asked for a new application to be <br />submitted. <br /> <br /> Ms. Ayala asked if the application was for a liquor store, could it be done without a <br />conditional use permit. <br /> <br /> Mr. Swift said yes. If the application were for a liquor store than only a zoning <br />certificate would be required. <br /> <br /> Mayor Tarver asked if Council could initiate a zoning ordinance modification to address <br />that anomaly. <br /> <br /> Mr. Swift said the location and the type of permit for liquor stores were being looked <br />at by staff. The idea was to modify the list of uses for all liquor stores, primarily within the <br />neighborhood/commercial centers. Council could initiate a code change to that effect. It could <br />be either site specific for this particular location or concerning neighborhood shopping centers. <br /> <br /> No motion was made to reconsider the prior decision. <br /> <br /> Stan Erickson, 3684 Chillingham Court, said while serving on the General Plan Steering <br />Committee and Housing Subcommittee, he spent considerable time considering the economic <br />impact of housing developments. There was a motion made to have an economic impact report <br />be required for each significant housing development application in Pleasanton. He said he <br />could not find this policy in the General Plan.
