She supported the restrictions that Mr. Pico <br />mentioned. <br /> <br /> It was moved by Mr. Pico, and seconded by Ms. Dennis, to deny the appeal (Case <br />AP-97-01), and to approve the application with the added conditions: hours of operation <br />would be from 6 a.m. to 10 p.m.; the sale of akohol would be !|mlted to beer and wine <br />only; and no window advertising of liquor or tobacco products would be allowed on the <br />front of the store. <br /> <br /> Mayor Tarver said with all the restrictions he would be surprised if Bonfare wanted to <br />move forward. But he supports what the residents were saying. He would like to see a market <br />where he could pick up something on his way home. He said he would support the motion. <br /> <br /> Ms. Michelotti asked if a liquor store were a permitted use for the proposed site. She <br />asked if Council was allowed to put restrictions on the advertising. <br /> <br /> Mr. Roush said it was within Council's discretion to limit the advertising. <br /> <br /> Mr. Swift said liquor stores are a permitted use for this area. <br /> <br /> Ms. Michelotti said she was not in agreement with everything that was being proposed, <br />but she was in agreement with having a convenience store for the seniors and felt it would be <br />beneficial for the community. She said she would support it. <br /> <br /> Ms. Ayala said she would like to have the store with restrictions rather than not have a <br />store at all. <br /> <br /> Mr. Caplan said in order to survive he would need the store to be open until till midnight <br />and felt he would have to withdraw his application. <br /> <br /> Ms. Ayala made a friendly amendment to extend the hours of operation to midnight. <br /> Mr. Pico said no. <br /> <br /> A substitute motion was made by Ms. Ayala, seconded by Ms. Michelotti, to adopt <br />Resolution No. 97-40, denying appeal (AP-97-01), thereby approving the application of <br />Todd Fujinaga/Bonfare Market, as f'ded under Case UP-97-03 with the amendments as <br />noted: the hours of operation would be 6 a.m. to 12 midnight; the sale of alcohol would <br />be limited to beer and wine only; and no window advertising of liquor or tobacco products <br />would be allowed on the front of the store. <br /> <br />Pleasanton City Council 5/06/97 <br />Minutes 12 <br /> <br /> <br />
