Ms. Dennis asked if there was any way to allow participation in the CC&R's process and <br />what the process would be for those interested in seeing the proposed CC&R's. <br /> <br /> Mr. Roush said the developer's attorney would draft the CC&R's and would send the <br />CC&R's to the City for review. If anyone expressed an interest, the City would notify that <br />person. <br /> <br /> Ms. Ayala asked about the flood zone. <br /> <br /> Mr. Swift commented the proposed project site was in a 100 year flood plain. The area <br />was protected by a dike. Improvements to the channel had been in Zone 7's plans for many <br />years and by combining the channels it would hold the 100 year flood. A protective berm would <br />be built around the homes for any run off that might occur and the area would be removed from <br />the 100 year flood zone. <br /> <br /> Mayor Tarver said he could not support the EIR and the amendment to the Specific Plan. <br />The underlying problem was growth management. How would the City be built out and when <br />would the infrastructure be in place to handle new development. The fly-over was several years <br />away. He would like to see the bigger picture before moving ahead. He understood why the <br />applicant was before the Council, and why it wanted the approval, but he was not prepared <br />tonight to deal with the other issues. <br /> <br /> Ms. Dennis said she liked the sports park and the affordable housing proposal. She had <br />concerns about the road going through to E1 Charro and had major concerns about signing the <br />pre-development agreement. Most of her concerns centered around the traffic issues and that <br />the traffic issues with Dublin had not been resolved. If she ended up supporting the project she <br />would not support it with opening the road. She would not support signing the pre-development <br />agreement with CalMat until more issues were worked out. Until the City found out whether <br />all the jurisdictions wanted to participate in the regional transportation fees she did not want to <br />send a message that the City would not welcome its participation to mitigate traffic concerns. <br />She also had lived with grading behind her house and it was a slow process. As to Mr. Garnet's <br />concerns, there were affordable units in other parts of the City and they did not have a negative <br />impact on the property values. Since the community has been more aggressive in adding <br />affordable housing to its housing stock, the City' s economic picture had brightened. There were <br />many things she liked about the project. She could not support growth management tonight <br />because she believed the city was working on a new system. The project should be put off until <br />August. <br /> <br /> Ms. Michelotti said that once in awhile there was a project that came along that met <br />many specifications that the community wanted. She believed that this was a project that did <br />that. Four to five years ago she sat with the sports groups and heard the need then for lighted <br />sports fields. With this project the City was not just getting the land for the sports field, it was <br />getting a fully developed sports park.
