MINUTES
OF THE
SPECIAL MEETING
OF
THE CITY COUNCIL

January 15, 1997

1. CALL TO ORDER

Mayor Ben Tarver called the Special Meeting of the City Council to order at 7:30 a.m.
Councilmembers present were Kay Ayala, Becky Dennis, Thomas P. Pico, Jr., and Mayor Ben
Tarver. Staff members present were: Deborah Acosta, City Manager; Michael H. Roush, City
Attorney; Randall A. Lum, Director of Public Works; and Steve Cusenza, Deputy Director of
Utilities.

Councilmember Michelotti was absent and excused.

2. CLOSED SESSION

Mr. Roush announced that the purpose of the special meeting was to meet with legal
counsel to discuss in closed session potential litigation against DERWA regarding its San Ramon
Valley recycled water program/EIR.

Before adjouming to closed session, the Mayor asked if anyone wished to address the
City Council on this matter.

Carl Morrison, appearing as a private individual, asked to be heard. He said that
although he is a consultant to DSRSD and DERWA, he was appearing today as a private citizen.
He indicated his belief that Council's real concerns were with issues concerning LAVWMA
rather than with the DERWA project. He believed that the DERWA project had nothing to do
with LAVWMA. He felt that if the Council chose not to file suit, it would go a long way in
facilitating discussions with LAVWMA

The Mayor thanked Mr. Morrison for his comments.

The Council then adjourned to closed session.

Page 1
01/15/97
