Mayor Tarver wondered if Mr. Chestnut was going around the process in obtaining the <br />permits, because the Planning Commission denied the application. <br /> <br /> Ms. Dennis asked if a structural report is required. <br /> <br /> Mr. Smith said the Uniform Building Code allows someone to build a two-story structure <br />following the minimum requirements of the Code without having an engineer involved. <br /> <br /> Ms. Michelotti understood that before Mr. Chestnut could get a permit for the roof, a <br />structural report would need to be done and the only thing that is allowed at this time is the <br />foundation work and the slab. <br /> <br /> Mr. Smith said that is correct. <br /> <br /> Ms. Michelotti asked if the barn was included when this item went before the Planning <br />Commission. <br /> <br /> Mr. Swift said no it was not. The second unit was not planned to be in the bam, nor was the <br />addition to the house. He said the barn was intended to remain on the site as a barn. He believed <br />now the barn is intended to become a garage. It is a legal non-conforming structure due to its <br />height and is allowed to remain. <br /> <br /> Ms. Michelotti asked Mr. Ciesielski if he understood that the bam is not included in the <br />appeal. <br /> <br /> Mr. Ciesielski said the confusion started when Mr. Chestnut tumed in his plans to the <br />Planning Department. The drawings regarding the bam are not complete drawings; they are an <br />outline, not showing any of the structure detail. The plans do not show a new foundation, new roof, <br />bracing, etc. So he believes things are being allowed that he has not been told about. He has a <br />problem with this because it is only four feet from his fence. He wondered if a reputable person <br />was doing the bracing to the structure. He wanted all constructionto stop until the Council looks at <br />the appeal. <br /> <br /> Ms. Michelotti said Mr. Chestnut had permission to put temporary bracing so the structure <br />will not fall over. The roof will not be replaced until a structural report is done. <br /> <br /> Mr. Ciesielski asked when such a report would be available. <br /> <br /> Mr. Swift said the barn is being treated as an existing structure.
