At this point the person speaking is <br />asking Council for reconsideration, but this is not the appropriate time to hold a public hearing <br />regarding the matter itself to be reconsidered. <br /> <br /> Mayor Tarver indicated that the only item before Council tonight is whether <br />CouncilmemberAyala, Councilmember Dennis or he wishes to reconsider the decision. <br /> <br /> Pat Nelson, 8088 Bethel Lane, asked Council to reconsider its decision. She showed <br />Council photographs of other homes in the area that are similar in color. She is disappointed that <br />Council denied the house color. She said what happened at the Council meeting had no likeness at <br />all to due process of law, which Council, as elected officials, should uphold. The Pleasanton <br />Municipal Code Section 18.20.060, states that the appeal process to the Council is as if the process <br />were a new process. Therefore, Council is not supposed to consider background information. She <br />felt the decision was based on personal opinion. She mentioned the occupancy permit. She said <br />she has an agreement to occupy the house and did not understand what the inside of the house had <br />to do with the color. She said her plans reflected the color "Santa Fe". The Planning Department <br />said put it down as a color and if a different tan color is found it can be dealt with at a later date. <br />During the approval process the color "Adobe" was written on the plans. She said there was no <br />Adobe color available, so they chose a golden tan color and applied a double mix to get it close to <br />the Adobe color. She said staff and the neighbors do not have a problem with the color. She said it <br />is common practice that adjustments are made in the field and then submitted for approval. She felt <br />the color was close to the "Adobe" color and therefore she proceeded. She felt the real issue was <br />occupancy not the color. She understood the West Foothill Overlay District was created to preserve <br />the beautiful ridge of Pleasanton. She supported this concept and took that into consideration when <br />choosing the color. She felt the color did fall within the parameters of the West Foothill Overlay <br />District. She said there is no ordinance that says the color must be dark brown or tan; she was <br />willing to go with a tan color and felt the color they chose would suffice. She understood there was <br />a process to follow in order to change the ordinance. She said that process has not been followed. <br />She has not received any notice saying the West Foothill Overlay District was going to be <br />discussed. The Ordinance has not changed, it still reads no bright light, orange or red color would <br />be allowed on the ridge and that the color must blend in with the natural surroundings. She <br />commented on Moller Ranch getting approval to be creative as they wish. Council has put staff in <br />a difficult situation. Council has directed staff that any home west of Foothill must be a chocolate <br />brown, but this is not legal. She felt that she has not been treated fairly. She mentioned homes in <br />Golden Eagle Farms that have been allowed to change the appearance of their homes from a darker <br />color to a lighter color and they did not go through a public hearing process. She asked Council to <br />reconsider. <br /> <br /> Larry Larsen, 5983 Hansen Drive, asked Council to reconsider its decision.
