Ms. Michelotti asked if the lot could be accessed from the hammerhead already designed. <br /> <br /> Mr. Swift said no, the house is already approved and the driveway is in the lower part of <br /> the hill. <br /> <br /> Mr. Pico understood that Bethel Lane was supposed to be built according to the <br /> improvements plans, but there were changes made in the field. <br /> <br /> Mr. Roush said there were changes made in the field but they are in substantial <br /> conformance with the approved plans. <br /> <br /> Ms. Dennis said she spoke with the Nelsons. She got the impression that the Nelsons <br /> were not asking to have the road pulled out. She felt the Nelsons' main concern was the contour <br /> on their property. They would like the contour changed to look more natural looking and a small <br /> amount of dirt moved onto their property where the hammerhead drive comes out. They are not <br /> asking for substantial changes and felt their requests could be accommodated. <br /> <br /> Mayor Tarver had a concern with all the things that were happening up there: the <br /> landslide on the backside of the lot, the drainage, a considerable amount of dirt moved to where <br /> it was not supposed to be moved, and the different elevations. <br /> <br />...... Ms. Dennis had the same concerns. <br /> <br /> Ms. Ayala said the contour of the land does not look natural. She was afraid that if it <br /> were left up to the lawyers of the property owners to resolve, nothing would be done. <br /> <br /> Mayor Tarver said staff is trying not to take sides. <br /> <br /> Mr. Pico asked staff to address the setbacks. <br /> <br /> Mr. Swift said the conditions of approval state that any house built on this lot must have <br /> setbacks from the property line and not from the hammerhead turnaround. The setback in the <br /> front would be 25 feet. <br /> <br /> Mr. Pico asked what the setback was from the oak trees located in the back. <br /> <br /> Mr. Swift said there is no built in setback. The conditions of approval require that the <br /> way the house sits on the lot would be subject to the Planning Commission's review and <br /> approval. <br /> <br /> Mr. Pico said the property owner could build the house that is being proposed.
