Mr. Swirl said Greenbriar is taking a risk by fronting all the money up from and hoping <br />it will get reimbursed at a later date. <br /> <br /> Mr. Pico clarified that Greenbriar was willing to do this. <br /> <br /> Mr. Swift said yes. <br /> <br /> Mayor Tarver said the section of road that goes through the Greenbriar property is being <br />paid for by Greenbriar. The road that goes through the New Cities Development property is <br />being funded by New Cities. The question is who will pay for the section of road that needs <br />to be constructed in order to have access to develop the property. Normally the developer is <br />asked to fund the road, but there is no developer developing in that section to fund the road. <br /> <br /> Mr. Swift said ultimately there will be development, but it is property owners with one <br />to three lots. <br /> <br /> Mayor Tarver said the issue is to continue the infrastructure so the development can <br />continue in North Sycamore. Option 1 in the Finance Plan has the golf course paying its fair <br />share for the roaa section that is going to the Greenbriar, Sportono and New Cities Deve;c~pment <br />properties. <br /> <br /> Ms. Michelotti said the amounts have been backed out of the pool. <br /> <br /> Mayor Tarver would like the golf course excluded from the reimbursement of the section <br />of road that goes to the Greenbriar, Sportono, and New Cities Development properties. <br /> <br /> Ms. Ayala asked if Mayor Tarver had any concern about the Supreme Court's decision <br />about fees that exceed the need generated by projects. <br /> <br /> Mayor Tarver had concerns about whether the City has a right to ask for the road to be <br />financed in the way the Finance Plan states. If the developer does not believe that it can pay <br />for the roadway in order to get to its property, then obviously the project should not proceed. <br />In order for the developers to develop the property, a two-lane road is needed to get from where <br />the existing road is to the property to be developed. <br /> <br /> It was moved by Ms. Ayala, and seconded by Ms. Michelotti, to adopt Resolution <br />No. 98-142, approving the North Sycamore Specific Plan Financing Plan and Technical <br />Report as set forth in Option 1, with the addition of a new condition #3. <br /> <br /> Ms. Michelotti wanted to explore the Mayor' s proposal about not having the golf course <br />pay its fair share.
