Ricardo Oliveira, 4839 Capricopus Avenue, Livermore, gave a brief background <br />regarding his business. At the September 9 Planning Commission hearing, issues were raised <br />regarding non-compliance of the business. He quoted from the Planning Commission staff <br />report, "a martial arts business would be an appropriate use in this center if it did not have any <br />noise, signage or parking impacts." Regarding the parking issue, the Planning Commission staff <br />report reads "besides the sites meeting the Municipal Code requirements, there are other reasons <br />why the staff believes the shopping center would have adequate parking for the proposed studio <br />and it would not impact the parking facility in a negative manner." He felt the Planning <br />Commission was confused. Originally the concerns were noise and lights and lack of <br />compliance and now traffic and parking have been added. He hoped the letters submitted on his <br />behalf from the community would shed light as to his character and what the martial arts school <br />is providing for the City of Pleasanton. <br /> <br /> Ms. Michelotti asked why he felt he did not need a conditional use permit when he <br />relocated his business to this site. <br /> <br /> Mr. Oliveira said when he opened his school he did not have any business background <br />and did not realize all the check points that needed to be taken care of when starting his <br />business. He had a mentor who took care of many steps for him. When he moved his business <br />to this location, he obtained his business and sellers license, but was unaware that he needed a <br />new conditional use permit. Had he been aware, he certainly would have applied for it. <br /> <br /> Ms. Michelotti asked if it had been his understanding that he did not need a conditional <br />use permit for this location. <br /> <br /> Mr. Oliveira said yes. He went through each of the proposed draft conditions and <br />explained how he has complied. He explained he does not have the financing to relocate his <br />business. This business is his livelihood and he has a considerable amount of money at stake. <br />He has pride and honor in his students and asked those who were present and in support of the <br />school at its present location to please stand. <br /> <br /> A considerable percentage of the audience stood up. <br /> <br /> Ms. Ayala asked if the seamstress neighbor agreed the noise level was reasonable. <br /> <br /> Mr. 0liveira said yes. He thanked the community for its support and spoke about the <br />service the school is providing to the community.
