Rod Kerr, 5664 Paseo Navarro, described the project and the reason for the appeal. He <br />felt the difference in what had been approved and what he was asking for was minor and would <br />have very little impact on the neighborhood. He said the heritage trees limit where a building <br />can be placed. The Planning Commission said it would have to grant a special privilege. He <br />showed photographs of the existing neighborhood and felt his project would not be out of <br />character. He also requested to allow the shop to be built within three feet rather than the <br />Planning Commission's requirement for five feet. <br /> <br /> Dick Greilich, 5670 Paseo Navarro, supported Mr. and Mrs. Kerr and hoped that <br />Council would approve the project. <br /> <br /> Dennis Spielvogel, 5658 Paseo Navarro, had no objections to the design and felt it would <br />have a positive impact on the neighborhood. <br /> <br /> Trudy Anne DeLeMos, 5667 Paseo Navarro, also supported the project and urged <br />Council to approve the addition. <br /> <br /> There being no other speakers, the public hearing was closed. <br /> <br /> Ms. Dennis said it was good to see neighbors supporting neighbors. She said it is tough <br />to make a decision upholding the appeal when the Planning Commission and staff <br />recommendations were for the five feet. She asked staff if there was anything else that could <br />apply. <br /> <br /> Mr. Swift said the only other avenue would be to amend the zoning ordinance to allow <br />three foot setbacks. <br /> <br /> Ms. Dennis asked if there was any kind of project redesign that would fit the setbacks <br />but also allow temporary enclosure that could move in and out of the two foot range. <br /> <br /> Mr. Swift said this option had not been explored. The cave is allowed to project into the <br />setback. It is hard to foresee a movable wall that would be practical and fit into the Kerr's <br />budget. <br /> <br /> Ms. Dennis said the application is great and was hoping to come up with another way <br />to accomplish what the Kerrs wanted. <br /> <br /> Ms. Michelotti asked if there was a way to approach the project without changing the <br />code. She thought that there had been variances granted under special circumstances. She said <br />in the first finding the Zoning Administrator said there were special circumstances. She asked <br />if there were any findings such as those mentioned that staff could agree with.
