Mayor Tarver said the issue is the RO water. <br /> <br /> Mr. Pico asked how the process could be started for a special relief permit. He said if <br />the City is going to lead in using RO treated water it should be able to lead in setting some <br />standards for disposing of the water in other ways. He looked to the Regional Water Quality <br />Control Board as the last resort before people look to ligation to resolve the issues. <br /> <br /> Mr. Wu understood the risk and the perceived risk. <br /> <br /> Mr. Pico said if the risk is not acceptable for the fish, it is not acceptable for the unborn <br />children. <br /> <br /> Ms. Ayala asked the panel if this issue was put to the vote of the people would it pass. <br />She felt the people would vote the project down. She asked for the Liaison Committee to <br />explain how the process took place. She felt it was important for the public to know. <br /> <br /> Mayor Tarver said the City has agreed in order to solve DSRSD's immediate sewer <br />problems. Given the information at the time and what was required to make all the parties agree <br />to the LAVWMA Principles of Agreement, the City agreed it would not interfere with the Clean <br />Water Revival project. He said the process has been going on for many years. He concluded <br />from the data and supporting documents that this project was an acceptable risk. But what he <br />is hearing this evening from the community is that it is not an acceptable risk. He is trying to <br />figure out how the Principles of Agreement can be adhered to without violating the community's <br />trust. That is why he was looking for other alternatives that the City could pursue to allow <br />DSRSD to get the sewer capacity it needs until the pipeline is approved (assuming it will be <br />approved in November). He is concerned about the City fulfilling its commitment in terms of <br />signing the Principles so DSRSD can move forward in the interim. He had a hard time signing <br />the Agreement but felt he had done his duty in representing his community. <br /> <br /> Ms. Michelotti said even if the LAVWMA project is approved in November, there would <br />be a period of time before the pipeline is ready. She was hearing tonight that the sewer capacity <br />is full and the RO project was to be used in the interim. <br /> <br /> Mayor Tarver asked for clarification. He understood the City of Livermore had capacity <br />in the pipe. If the capacity is used up, then something has gone wrong. <br /> <br /> Ms. Michelotti thought there was capacity to be borrowed. <br /> <br /> Mr. Requa said part of the capacity issue is contractual. DSRSD is limited with the <br />discharge between agreements with Pleasanton and Livermore. If Pleasanton and Livermore <br />allow DSRSD to use the capacity that is available, that would assist substantially in the dry <br />weather and may well allow use of the existing pipeline without having to use the RO injection <br />project in the summertime.
