Ms. Dennis asked if any manufacturers had been sued? <br /> <br /> Mr. Morgan did not know. He said it would be unlikely that a manufacturer would be <br />in business if it was manufacturing unsafe firearms. <br /> <br /> Ms. Dennis read that Laurison Engineering had been sued by owners of firearms that had <br />been injured. She mentioned the Clock was not on the roster. <br /> <br /> Mr. Morgan understood the Glock was not on the roster. His point was it should be <br />because it met the criteria listed in the ordinance. His intention was if Council wished to protect <br />the police officers from unsafe firearms, it would not allow them to use any of the firearms <br />listed on the roster. But if the police are being allowed to use the firearms, then perhaps the <br />firearms are not unsafe. <br /> <br /> Ms. Ayala asked for clarification that the Police Chief had stated that none of the police <br />officers were using any guns listed on the roster. <br /> <br /> Mr. Roush said there are no department issued guns on the list. <br /> <br /> Mayor Tarver said people are saying that because of the criteria listed, any gun could be <br />put on the list if the Police Chief chose to do so. <br /> <br /> Mr. Roush said if a particular firearm met the criteria it could go on the list. There is <br />a procedure set forth in the ordinance to do this. He was not aware of any effort to add any <br />guns to the list. <br /> <br /> Ms. Michelotti understood that the ordinance did not state the gun material had to be <br />steel; it could be something else so long as it met a high degree of resiliency. <br /> <br /> Mr. Morgan said the ordinance stated steel or forged alloy. <br /> <br /> Mr. Roush said the ordinance stated, "of heat treated carbon, steel forged alloy or other <br />material of equal or higher tensile strength". <br /> <br /> Mr. Morgan mentioned other guns that did not come under the criteria listed. But they <br />are designed in such a way that the parts are unstressed. His point was there are guns that <br />should be on list but are not. He read Section 6.64.230, additions to the roster, and said the <br />language was explicit enough to include any firearm that did not fall under the very narrow <br />definition in the ordinance. <br /> <br /> Mr. Roush said only the guns on the roster were being proposed this evening.
