Ms. Michelotti felt that staff had done that except for on two models. She remembered <br />in the New Cities Development project, Walnut Glen, the secondary units were under a blanket <br />condition. <br /> <br /> Mr. Swift said the builder offered secondary units as an option in the first phase; any <br />subsequent detached secondary units must be approved on a case by case basis. <br /> <br /> Mr. Constanzo said page 23 of the staff report addressed Ms. Dennis concerns. <br /> <br /> Ms. Michelotti reminded everyone that this project was before Council on appeal this <br />evening because the Planning Commission made a finding that the project did not conform to <br />the General Plan. <br /> <br /> There being no further speakers, the public hearing was closed. <br /> <br /> Ms. Acosta commented, given the late hour, Council could continue Item 6b, Proposed <br />Zone 7 Water Service Expansion Policy and the closed session item. <br /> <br /> Mr. Roush said the closed session could be moved to Monday, February 23, 1998. The <br />expansion policy item before the Zone 7 Board had been taken off the Board' s agenda so it was <br />not as time sensitive for Pleasanton. He suggested continuing the ordinances on the firearms <br />because of the late hour. <br /> <br /> Mayor Tarver continued Item 6b, the proposed Zone 7 water service expansion policy, <br />Item 4j, Ordinance No. 1719, prohibiting sale of "Saturday Night Specials" and Item 4k, <br />Ordinance No. 1738, amending the Pleasanton Municipal Code regarding zoning in which sale <br />of firearms is permitted. <br /> <br /> There was a break at 10:35 p.m. <br /> <br /> The meeting reconvened at 10:41 p.m. <br /> <br /> Mr. Pico asked if condemnation action required only a majority vote by the Council? <br /> <br /> Ms. Acosta said it required a 4/5ths vote by the Council. <br /> <br />Mr. Pico heard this evening at least three families that said if they had a choice they <br />would not vote for this project. If these families choose not to sell their property and the City " <br />does not initiate condemnation proceedings, then this particular plan would basically have to go <br />through another approval process. <br /> <br /> Ms. Acosta said it would be an unlikely situation if the City found the plan not to be <br />consistent with the General Plan and all the property owners refused to participate. <br /> <br />Pleasanton City Council 2/17/98 <br />Minutes 20 <br /> <br /> <br />
