Ms. Acosta said another advantage to denying a project without prejudice is the applicant <br />did not have to pay new fees. <br /> <br /> Mayor Tarver stated if the Council rescinded the ordinance when presented with a <br />qualified referendum, it would require a one year waiting period. If the Council accepted a <br />request by the applicant to withdraw the application, then there would be no waiting period. <br />Once the referendum was qualified by the Registrar of Voters and the court finds the petition <br />valid, then Council would have legal recourse to rescind the ordinance. <br /> <br /> Mr. Roush said that is correct. <br /> <br /> Mr. Pico asked if the referendum did not qualify for some reason or if the Court <br />determined the petition was inadequately prepared or circulated, and Council were to submit a <br />repeal of the ordinance to the voters, would there be a time frame involved? <br /> <br /> Mr. Roush said as long as the applicant did not have a vested right there was no time <br />frame. He felt a more comprehensive <br />plan for the area could be put together that would include El Charro. The General Plan called <br />for such a study to be done. <br /> <br /> Judith Fox, 3645 Virgin Island Court, described her experience while gathering <br />signatures at the Farmers Market and complained of harrassment and intimidation. <br /> <br /> Matt Sullivan, 4324 Muirwood Drive, felt his first amendment rights and civil rights had <br />been violated by paid political operatives working to achieve the goals of the developer. He did <br />not agree with the tactics used. He felt the concerns of the citizens were not being addressed. <br /> <br /> Greg Hildebrand, 15 12 Maple Leaf Drive, said he had confidence that the referendum <br />would qualify.
