Mayor Tarver asked why Ponderosa did not raise its concerns at the beginning of the <br />petition gathering? <br /> <br /> Mr. Meeks said Ponderosa was not given the opportunity to review the petition prior to <br />its circulation. It was his understanding that the City Attomey had been given an opportunity <br />to review the petition and make comments. But the petition that showed up on the streets was <br />not the petition that had been reviewed by the City Attorney. <br /> <br /> Mayor Tarver clarified that Ponderosa wanted Council to rescind the ordinance on its <br />behalf, so Ponderosa could continue working on the project and in return Ponderosa would <br />withdraw its lawsuit. <br /> <br /> Mr. Meeks felt the people who signed the petition were very clear on the reason for the <br />petition (traffic). Ponderosa would like the opportunity to work with those people and determine <br />what it would take to get their support for the project. Ponderosa believed the time to do this <br />was now. He said Ponderosa had met with Ms. Varela's attorney to start the negotiating <br />process. He said the property is in the General Plan and someday there will be a development <br />built on that property. Ponderosa believed it was the best qualified company for that <br />development. He was willing to sit down with anyone and try to mitigate the concerns. <br /> <br /> Mayor Tarver said he was hesitant to take action on Ponderosa's request until he knew <br />what the community wanted Council to do. Also he felt Council was not in a position to take <br />action until Ponderosa's lawsuit had been withdrawn or settled. <br /> <br /> Mr. Meeks reiterated the request again. <br /> <br /> Ms. Ayala asked if he felt the timing was right to try and put together another proposal. <br /> <br /> Mr. Meeks said yes. He understood it might take four to six months, but he felt the time <br />to start working with the neighborhood was now. <br /> <br /> Ms. Ayala felt the start of the healing process would be for Ponderosa to drop the <br />lawsuit. She believed the timing was not right to meet with the neighborhood. <br /> <br /> Ms. Michelotti asked if Ponderosa would be willing to make another offer. She did not <br />like being forced to make a decision. She said even if Ponderosa negated all the petitions, she <br />would still take an action to put it on the ballot. She did not understand what Ponderosa was <br />trying to accomplish. <br /> <br /> Mr. Meeks said Ponderosa would be prepared to drop the lawsuit. <br /> <br /> There was no further public testimony. <br /> <br />Pleasanton City Council 1/20/98 <br />Minutes 10 <br /> <br /> <br />
