Gold
Creek HOA was given possession of the creek in 1990 by the developer. Since that time the
HOA has' maintained the weeds in the creek. She received a call from Mr. Brock in the Fire
Department saying that he had a request from an adjacent homeowner in the Association to
remove a dead oak tree within the creek bed. She was here this evening to ask if the City would
take possession of the creek. She submitted photos of the creek and the dead oak tree. She felt
there 'was enough room for the city's maintenance equipment. She asked Council to do a
feasibility study.

Ms. Michelotti asked if there was a public service easement that goes from Springdale
to Pleasant Hill?

Ms. Jervis said yes.

Ms. Michelotti asked if there was a sign that said "private property" at the entrance to
the easement.

Ms. Jervis said the signs had been removed. In 1990 the HOA wanted to put up fences,
.but was told it could not because of the public service easement. She understood that the
water/sewer rebate issue was still being considered. She explained that the HOA for seven years
was overcharged as a single family residence and the total amount of the rebate is $43,680. She
said the HOA would be willing to let the City keep the rebate if it was willing to take possession

Pleasanton City Council 4 08/04/98
Minutes
