CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-66 <br /> <br /> RESOLUTION VACATING PUBLIC SERVICE EASEMENT IN TRACT <br /> 4611' <br /> <br />WHEREAS, on February 16, 1988, the City Council received a staff <br /> report (SR 88:62) recommending the vacation of a public <br /> service easement across Lots 52 and 53 of Tract 4611, <br /> Mission Hill, generally known as 433 Los Rios Court and <br /> 443 Los Rios Court, more particularly described on <br /> Exhibit "A" attached hereto and incorporated herein by <br /> this reference; and <br /> <br />WHEREAS, the public service easement is not required and has not <br /> been used since dedication; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing that <br /> the public service easement is not required for public <br /> utility purposes pursuant to Section 8334 of the Streets <br /> and Highways Code, the public service easement described <br /> in Exhibit "A" is hereby vacated. <br /> <br />Section 2: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office of <br /> the Alameda County Recorder. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 16, 1988 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wilson, and <br /> Mayor Mercer <br />NOES: None <br />ABSENT: None NET~HR.~R <br />ABSTAIN: None <br /> <br />ATTEST: <br /> KE <br /> <br />By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br /> Peter D.
