CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-39 <br /> <br /> RESOLUTION MAKING CONCLUSIONS OF LAW AND ESTABLISHING <br /> PENALTY FOR CARDROOM LICENSE VIOLATION OF PASTIME POOL <br /> <br />WHEREAS, a duly noticed public hearing was held on January 19, <br /> 1988 regarding the violation of the regulations of <br /> cardroom licenses by Pastime Pool; and <br /> <br />WHEREAS, after hearing all the evidence and testimony, Council <br /> adopted findings of fact and conclusions of law and <br /> based on those findings determined the appropriate <br /> penalty; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The following conclusions of law are hereby made: <br /> <br /> 1. The owners of Pastime Pool, through Jay Nelson, <br /> violated Section 6.12,080 P.M.C. (hours of <br /> operation) by permitting operation of the cardroom <br /> after 2:00 a.m. on the morning of December 29, <br /> 1987. <br /> <br /> 2. The owners of Pastime Pool, through Jay Nelson, <br /> violated Section 6.12,140 P.M.C. (permitted card <br /> games) by allowing playing of a game prohibited by <br /> that section. <br /> <br /> 3. The owners of Pastime Pool, through Jay Nelson, <br /> violated Section 6.12,150 P.M.C. (state law <br /> violations). <br /> <br />Section 2: Based upon the findings of fact and conclusions of <br /> law made by the City Council, the following discipline <br /> is imposed upon the licensee Pastime Pool and its <br /> owners, Jay Nelson and Frank Shenave: <br /> <br /> Suspension of License of cardroom for thirty (30) days <br /> commencing with December 29, 1987, and concluding <br /> January 27, 1988. <br /> <br /> <br />
