CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 88-35 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ELECTING TO BE ALLOCATED CERTAIN TAX REVENUE8 PURSUANT TO HEALTH AND SAFETY CODE SECTION 33676 WHEREAS, by Resolution NO. PC-87-126, adopted on November 24, 1987, the Planning Commission of the City of Pleasanton selected and designated the boundaries of the project area (the "Project ARea") for the proposed Downtown Community Development Project (the "Project"), approved a Preliminary Plan for the Project and submitted said Preliminary Plan to the Pleasanton Community Development Agency (the "Agency"); and WHEREAS, the Agency is preparing a proposed community development plan (the "Community Development Plan") for the Project; and WHEREAS, Section 33676 of the Health and Safety Code provides that prior to the adoption of a Community Development Plan an affected taxing agency may elect to receive, in addition to the portion of taxes allocated to the affected taxing agency pursuant to Health and Safety Code Section 33670(a), all or any portion of the tax revenues allocated to the Agency pursuant to Health and Safety Code Section 33670(b) which are attributable to: (a) the tax rate increases imposed for the benefit of the taxing agency after the tax year in which the ordinance adopting the Community Development Plan becomes effective; and/or (b) the increases in the annual assessed value of taxable property in the project area, as the assessed value is established by the assessment roll last equalized prior to the effective date of the ordinance adopting the community development plan, calculated under Revenue and Taxation Code Section 110.1; and WHEREAS, the City Council desires to receive such tax revenues; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council of the City of Pleasanton hereby elects to be allocated, in addition to the portion of taxes allocated to the City pursuant to Health and Safety Code Section 33670(a), all of the tax revenues allocated to the Agency pursuant to Health and Safety Code Section 33670(b) from the Project which are attributable to the following:
