CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-304 <br /> <br /> RESOI/3TION ESTABLISHING TIE VOTE PROCEDURE <br /> FOR NOVEMBER 8, 1988 ELECTION <br /> <br />WHEREAS, prior to the November 8, 1988 election, the City <br /> Council must establish a procedure to resolve tie <br /> votes should a tie vote occur; and <br /> <br />WHEREAS, the Assistant City Manager presented the City <br /> Council with two options available to address this <br /> issue; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Council hereby selects alternative #2, order a <br /> special run-off election in case of a tie vote at <br /> the November 8, 1988 election, as follows: <br /> <br /> The special election must be held on a Tuesday, not <br /> less than 40 days nor more than 125 days after the <br /> certification of the election which resulted in the <br /> tie vote. If a regular election is to be held <br /> throughout the City during this time period, the <br /> special run-off election must be consolidated with <br /> the regular election. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 5, 1988 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wilson, and <br /> Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTEST: KENNETH R.
