The Council's concerns should be <br /> relayed to the County Waste Management Authority <br /> for its inclusion in the final plan. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />1986 State Legislation, AB 2948 Tanner, bans land disposal <br />of untreated toxic waste in California after April 1990. In <br />anticipation of this, the law also requires that every county <br />prepare a Hazardous Waste Management Plan in order to handle <br />the waste generated within its jurisdiction. The purpose of <br />the legislation is to assess the need within the county for <br />hazardous materials processing and disposal facilities, and <br />to create the planning and permitting framework needed by <br />private development to fulfill that need. <br /> <br />The State law requires that the problem of hazardous waste <br />disposal be planned for at the county level. The Alameda <br />County Plan Hazardous Waste Management Plan (CHWMP) is being <br />prepared under the direction of the Alameda County Waste <br />Management Authority, a joint powers agency composed of the <br />County and the cities of Alameda County, including <br />Pleasanton. <br /> <br />Ultimately, the City will be required to amend its general <br />Plan to include the CHWMP. The policies and programs of the <br />CHWMP will be those of the City when addressing hazardous <br />waste issues. Therefore, it is critical for your Council to <br />comment on the draft plan in order to express the concerns of <br />the City and to represent its interests prior to final plan <br />preparation. <br /> <br />ADOPTION OF THE CHWMP <br /> <br />Written comment on the Draft CHWMP will be accepted through <br />June 30, 1988. The Draft EIR prepared in conjunction with <br />the plan was recently received by the City, and comments are <br />due 45 days after receipt. <br /> <br />It is expected that the Final CHWMP and EIR will be prepared <br />in September, 1988, and formal approval by City Councils, the <br />Board of Supervisors and the Waste Management Authority will <br />begin. A majority of cities in the County, representing a <br />majority of the County's population, must approve the plan <br />for it to become effective. <br /> <br />The Tanner law requires that the approved plan be submitted <br />to the State Department of Health Services by September 30, <br />SR:88:299 <br /> <br /> <br />
