In the event that either City or Owner shall at <br />any time or times waive any breach of this agreement by the <br />other, such waiver shall not constitute waiver of any other or <br />succeeding breach of this agreement, whether of the same or any <br />other covenant, condition or obligation. <br /> <br /> 9. Binding on Land and Successors. All covenants, promises <br />and agreements contained in this agreement shall pertain to and <br />do hereby expressly run with the land controlled by Owner and <br />described herein. This agreement shall bind and inure to the <br />parties hereto, including heirs, assigns, executors, <br />administrators, and all other parties whether they succeed by <br />operation of law or voluntary acts of Owner. Signatures and <br />execution of all parties shall be acknowledged before a Notary <br />Public.
