CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-215 <br /> <br /> RESOLUTION VACATING A PUBLIC SERVICE EASEMENT IN <br /> TRACT 5699, HERITAGE OAK ESTATES <br /> <br />WHEREAS, at its meeting of May 15, 1988, Council reviewed <br /> the staff report (SR 88:212) recommending the <br /> vacation of a sanitary and storm drainage easement <br /> located in Tract 5699, Heritage Oak Estates, more <br /> particularly described on Exhibit "A" attached <br /> hereto and incorporated herein by this reference; <br /> and <br /> <br />WHEREAS, the public service easement has been superseded by <br /> relocation and there are no other public facilities <br /> located within the easement; <br /> <br />WHEREAS, it is appropriate to authorize the City Manager to <br /> execute an easement Quit Claim Deed from the City <br /> of Pleasanton to Robert A. Connolly and Octavia C. <br /> Connolly transferring the vacated public service <br /> easement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> that the public service easement is not required <br /> pursuant to Section 8333(c) of the Streets and <br /> Highways Code, the public service easement <br /> described in Exhibit "A" is hereby vacated. <br /> <br />Section 2: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office <br /> of the Alameda County Recorder. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the public service easement vacated no <br /> longer constitutes a public service easement. <br /> <br />Section 4: The City Manager is authorized to execute an <br /> Easement Quit Claim Deed from the City of <br /> Pleasanton to Robert A. Connolly and Octavia C. <br /> Connolly. <br /> <br />Section 4: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
