CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-190 <br /> <br /> ACCEPTANCE OF PUBLIC IMPROVEMENTS - HOPYARD ROAD <br /> SOUNDWALLS, PROJECT NO. 87-53, AND APPROVAL OF FINAL <br /> PROGRESS PAYMENT TO THE YARD LUMBER AND FENCE COMPANY <br /> <br /> WHEREAS, work by The Yard Lumber and Fence Company on the Public <br /> Improvements - Hopyard Road Soundwalls, Project No. <br /> 87-53, has been satisfactorily completed; and <br /> <br /> WHEREAS, it is appropriate to authorize the final progress <br /> payment; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The work on the Hopyard Road Soundwalls is hereby <br /> accepted. <br /> <br /> Section 2: The Director of Finance is instructed to prepare a <br /> warrant in the amount of $124,869.63 in favor of The <br /> Yard Lumber and Fence Company in satisfaction of the <br /> final progress payment for the above-accepted work on <br /> Project No. 87-53. Ten percent (10%) of the total <br /> contract or $12,486.96 will be retained until thirty <br /> (30) days after filing of the Notice of Completion. <br /> <br /> Section 3: The City Attorney is directed to file a Notice of <br /> Completion with the Alameda County Recorder. <br /> <br /> Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED MAY 3, 1988 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Butler, Mohr, Wilson, and <br /> Mayor Mercer <br /> NOES: None <br /> ABSENT: None ~ ~ <br /> ABSTAIN: None <br /> <br /> ATTEST: ; <br /> KENNETH R.
