CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-429 <br /> <br /> RESOI/JTION ACCEPTING A 2.4 ACRE PARCEL <br /> FROM ROBERT AND CAROL MOLINARO FOR <br /> NIELSEN PARK SUBJECT TO CERTAIN <br /> CONDITIONS <br /> <br />WHEREAS, at its meeting of September 6, 1988, Council <br /> reviewed the report of the Acting City Attorney <br /> (SR 88:413) regarding the necessity of obtaining <br /> property from Robert and Carol Molinaro for <br /> completion of Nielsen Park; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which <br /> time testimony from interested parties was heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby accepts an approximately <br /> 2.4 acre parcel, more particularly described on the <br /> attached exhibit, from Robert and Carol Molinaro <br /> for completion of Nielsen Park and for street <br /> right-of-way for Stoneridge Drive and Kamp Drive <br /> extensions, subject to the following conditions: <br /> <br /> 1. If Stoneridge Specific Plan has not been <br /> approved by January 1, 1989, the remaining <br /> portion of Mr. Molinaro's parcel, <br /> approximately 19 acres, would be permitted to <br /> be deleted from the Stoneridge Specific Plan <br /> and be allowed to make an application for <br /> planned unit development approval and <br /> subsequent growth management approval. <br /> <br /> 2. The cost of one-half of the extension of Kamp <br /> Drive and a portion of Stoneridge Drive will <br /> be constructed at the expense of Shea Homes <br /> with no reimbursement sought from the owner of <br /> the 19 acre parcel. <br /> <br /> 3. The dedication of the parkland would satisfy <br /> all park dedication fees, irrespective of <br /> number of units approved for the 19 acre <br /> parcel. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
