AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this day of <br /> , 1988 by and between the CITY OF PT~ASANTON, a <br />municipal corporation (hereinafter referred to as "City") and <br />THE ROMAN CATMOLIC BISHOP OF OAKLAND, a corporation sole <br />(hereinafter referred to as "Catholic Church"). <br /> <br /> R E C I T A L S <br /> <br /> A. The City requires land for a proposed park, Nielsen <br />Park, and road right-of-way for the proposed extension of <br />Stoneridge Drive. <br /> <br /> B. The Catholic Church owns three parcels (APN <br />946-4550-1, 946-4550-3 and APN 946-4550-17) located in the <br />City of Pleasanton, between Rheem Drive and Oakland Avenue <br />and south of the proposed Stoneridge Drive (formerly Trenery <br />Drive) consisting of approximately 13.21 acres. <br /> <br /> C. The City presently may have access rights to a <br />thirty foot wide strip of land for road right-of-way along <br />the former Trenery Drive, which parallels the northern <br />boundary of the subject Catholic Church property. <br /> <br /> D. The City's General Plan designation for the <br />Catholic Church property is medium density residential. <br />Probable density for this parcel would be two to six dwelling <br />units per acre. <br /> <br /> E. Notwithstanding the General Plan designation for <br />residential use, the Catholic Church intends to develop land <br />uses only for church related uses. No residential uses, <br />except residences for church employees, are contemplated by <br />either party for the approximately 14 acre parcel. <br /> <br /> F. Both parties to this Agreement agree that the City <br />is receiving land equal to or greater than the value of <br />public improvements not required to be constructed by the <br />Catholic Church. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants <br />and promises contained herein, the parties agree as follows: <br /> <br /> 1. City Obliqations. The City shall install public <br />street curb and gutter improvements and related public <br />improvements such as signage and striping in the area <br />proposed for the Stoneridge Drive extension and more <br />particularly described in Exhibit "A", attached hereto and <br />incorporated herein by this reference. The City shall <br />determine the timing of said public improvements. <br /> <br /> Page <br /> <br /> <br />
