Reserving to first part7 its existing line of poles and all wires and <br /> cables attached thereto or suspended therefrom wi~h all crossarms, ~uys, <br /> anchors and other appliances and fixtures used in connection with said poles, <br /> wires and cables; the right to erect and construct an additional line of <br /> poles, with necessary wires and cables, and to suspend from any of said <br /> poles such additional wires and cables as first party shall from time to time <br /> deem necessary for the transmission and distribution of electric ener~, and <br /> for communication purposes; and the right to reconstruct, replace, relocate, <br /> remove, maintain and use all of said facilities; together with a right of way, <br /> on, along and in all of said real property. <br /> <br /> Further reserving to first par~y the right: <br /> <br /> (a) to use said real proper~y to provide access to any of first partT's <br />easements and facilities on lands adjacent to said real property; <br /> <br /> (b) from time to time to trim and to cut down and clear away any and all <br />trees and brush now or hereafter on said real property which in the opinion of <br />first party may be a hazard to any of said facilities, b7 reason of the danger <br />of falling thereon, or may interfere with the exercise of first party's rights <br />reserved herein; provided, however, that all trees which first party is hereby <br />authorized to cut and remove, if valuable for timber or wood, shall be the <br />property of second party, but all tops, lops, brush and refuse wood shall be <br />burned or removed by first party; <br /> <br /> (c) to install, maintain and use gates in all fences which now cross or <br />shall hereafter cross said real property; and <br /> <br /> First party agrees to indemnify second party against any loss and damage <br />which shall be caused by the exercise of said access or by any wrongful or <br />negligent act or omission of first party or of its agents or employees in the <br />course of their employment. <br /> <br /> -2- <br /> <br /> 7s-s12 <br /> <br /> <br />
