3.3 Term of Obliqation. The Association's obligations <br /> under Section 3.1 and 3.2 shall commence upon the later <br /> of (i) the date of this agreement, or (ii) the date <br /> upon which the City Council of the City accepts <br /> ownership of the street improvements and other public <br /> improvements under construction and shall continue <br /> throughout the term of this agreement, unless <br /> terminated as provided in Section 5.3. <br /> <br /> ARTICLE 4 <br /> PERMISSION TO ENTER <br /> <br /> The City hereby grants to the Association and its agents, <br />employees, and contractors permission to enter upon any real <br />property within the areas described in Sections 1.1, 2.1, and <br />Article 3 owned by the City or for which the City has been <br />granted a public service easement or temporary landscape <br />easement, for the purposes of performing any maintenance required <br />under Sections 1.2, 2.2, and Article 3, provided that any and all <br />contractors employed by the Association to perform any <br />maintenance required under Sections 1.2, 2.2, and Article 3 must <br />obtain an encroachment permit from the City, which the City shall <br />issue without charge to such contractor or to the Association. <br /> <br /> ARTICLE 5 <br /> ASSESSMENT DISTRICT <br /> <br /> 5.1 Maintenance District Contemplated. The City and the <br /> Association contemplate the possible establishment of a <br /> landscaping and street lighting maintenance district <br /> (the "District") pursuant to California law for the <br /> purposes of maintaining the landscaping, street <br /> lighting, and other public improvements covered by <br /> this agreement. <br /> <br /> 5.2 Cooperation. The City agrees that, upon receipt of an <br /> appropriate petition, it shall cooperate with the <br /> Association and land owners within Hacienda Business <br /> Park to undertake and complete any proceedings <br /> required under California law for the establishment of <br /> the District. <br /> <br /> 5.3 Termination of Association's Obliqations. If the <br /> District is established as provided in this article, <br /> the Association's obligations under this agreement <br /> with respect to any maintenance obligations to be <br /> undertaken by the District shall terminate as of the <br /> first day of the first fiscal year for which <br /> assessments are first levied by the District. <br /> <br /> 8 <br /> <br /> <br />
