Honorable Mayor and Members of the Council: <br /> <br />THE PURPOSE OF T~IS }~&RING: <br /> <br />The Council is acting as an administrative review body. As <br />such it is to be guided by the provisions of Section 1094.5 <br />of the Code of Civil Procedure. These provisions require <br />that you consider relevant evidence as presented to you and <br />that you make findings prior to taking action to uphold the <br />revocation decision of the Chief of Police. <br /> <br />The appellants will be given the opportunity to submit <br />additional information to you, including evidence mitigating <br />the charges against them and/or character evidence supporting <br />their worthiness for the continued privilege of holding a <br />cardroom permit. <br /> <br />The staff may present additional evidence relevant to the <br />case. Such information might include negative character <br />evidence including prior and/or continuing acts of <br />unworthiness. <br /> <br />All the evidence thus compiled will form the basis of the <br />record of this action. While the final action on this matter <br />must take place in the public meeting following this hearing <br />(or at your next public meeting), the actual record of these <br />proceedings is to remain confidential unless it is the desire <br />of the appellants to disclose such information. <br /> <br /> <br />
