Resolution No. 88-382
Page Two

above-noted conviction, a felony involving
moral turpitude. The failure of the non-
convicted co-permittee to take reasonable
steps to prevent drug dealing on the premises
under the circumstances further warrants
permit revocation. In addition, this action
follows a previous instance of permit
suspension in January of 1988. This finding
is supported by the evidence as stated in the
Chief of Police's revocation letter of
June 29, 1988, attached hereto and
incorporated herein by this reference.

Section 2: Denies the appeal of Jay J. Nelson and Frank R.
Shenave from the cardroom permit revocation
decision of the Chief of Police.

Section 3: That Frank R. Shenave and Jackie Shenave be
advised that they may apply for a separate cardroom
permit as individuals subject to the appropriate
requirements and qualifications of the Municipal
Code, including City Council review.

Section 4: This resolution shall become effective
immediately upon its passage and adoption.

THIS RESOLUTION ADOPTED AUGUST 16, 1988 BY THE FOLLOWING
VOTE:

AYES: Councilmembers - Brandes, Butler and Mohr
NOES: Councilmember Wilson and Mayor Mercer
ABSENT: None
ABSTAIN: None ~~~t~~
~J~mes ~.
