Conclusion
The Staples Ranch MOU obligates the City to process a development application which
includes improvements to EI Charro Road. To identify appropriate roadway and
infrastructure improvements and a mechanism to pay for these improvements, it has
been necessary for the City to cooperate with the parties included in these agreements.
Further, the timing of proposed development activity in Livermore and concerns raised
by Vulcan Materials regarding the potential impact of this development on its
operations, have prompted all parties to resolve these matters as cooperatively as
possible. Consistent with the MOU, SPA is required to pay for all major public
infrastructure and Pleasanton retains its previous responsibility to pay a pro rata share
of the I-580 improvements. Also, Section 10 provides for a cost sharing formula
between Livermore and Pleasanton to fund future traffic improvements if needed to
retain LOS D at the EI Charro/Jack London intersection. Finally, these agreements do
not obligate the City Council to approve the Staples Ranch project as outlined in the
MOU and staff has required language in the Cost Sharing agreement stating that the
Council's discretionary approval is not altered.
The recommended agreements represent an effort to work cooperatively to address the
interests of all of the parties with the goal of avoiding future conflicts and meeting each
parties interest.
Submitted by:
Rob Wilson
Public Works Director
Fiscal Review:
~. ~~~~
David P.
