Conclusion <br />The Staples Ranch MOU obligates the City to process a development application which <br />includes improvements to EI Charro Road. To identify appropriate roadway and <br />infrastructure improvements and a mechanism to pay for these improvements, it has <br />been necessary for the City to cooperate with the parties included in these agreements. <br />Further, the timing of proposed development activity in Livermore and concerns raised <br />by Vulcan Materials regarding the potential impact of this development on its <br />operations, have prompted all parties to resolve these matters as cooperatively as <br />possible. Consistent with the MOU, SPA is required to pay for all major public <br />infrastructure and Pleasanton retains its previous responsibility to pay a pro rata share <br />of the I-580 improvements. Also, Section 10 provides for a cost sharing formula <br />between Livermore and Pleasanton to fund future traffic improvements if needed to <br />retain LOS D at the EI Charro/Jack London intersection. Finally, these agreements do <br />not obligate the City Council to approve the Staples Ranch project as outlined in the <br />MOU and staff has required language in the Cost Sharing agreement stating that the <br />Council's discretionary approval is not altered. <br />The recommended agreements represent an effort to work cooperatively to address the <br />interests of all of the parties with the goal of avoiding future conflicts and meeting each <br />parties interest. <br />Submitted by: <br />Rob Wilson <br />Public Works Director <br />Fiscal Review: <br />~. ~~~~ <br />David P.
