DISCUSSION <br />I. Pre-Development and Cooperation Agreement between the City of Livermore. <br />Alameda County Surplus Property Authority, County of Alameda, Vulcan Materials, and <br />the City of Pleasanton <br />EI Charro Road is the primary access for the quarry land located south of the Staples <br />Ranch project and north of Stanley Boulevard. South of Freisman Road, the existing EI <br />Charro Road is a private road owned by Vulcan Materials. As a condition of Vulcan's <br />mining permit, Vulcan has offered to dedicate EI Charro Road to the County. However, <br />the County cannot accept the dedication without maintaining access to the quarries. <br />To accommodate the quarry access requirements, staff from Pleasanton, Livermore, <br />Alameda County, the Surplus Land Authority, and Vulcan Materials met regularly for <br />over a year to discuss traffic access, circulation, and safety concerns along EI Charro <br />Road. The discussions considered the potential development of both the EI Charro <br />Specific Plan and Staples Ranch projects in conjunction with existing and future traffic <br />from the quarries. The conceptual design of EI Charro Road as identified in the <br />agreement addresses Vulcan's concerns. <br />The purpose of this agreement is to establish design, construction and access <br />requirements for EI Charro Road improvements that meet the needs of all parties <br />including Vulcan Materials' concerns regarding traffic circulation and potential safety <br />impacts of new development associated with the Staples Ranch and EI Charro Specific <br />Plan projects. Key terms of the Agreement are as follows: <br />Establishes design standards, construction requirements and timetables for the <br />construction of EI Charro Road to assure the roadway meets the needs of all parties. <br />Note that the timetables do not require the roadway improvements to be <br />constructed. Rather, they relate to the term of construction if the roadway is <br />improved. <br />Establishes that EI Charro Road can be constructed by either the City of Livermore <br />or Pleasanton depending on development activity. Because Livermore has already <br />approved the 42 acre Prime Outlet retail center at the corner of EI Charro and I-580, <br />it is assumed that its development will precede any development at Staples Ranch <br />and therefore, the agreement assumes Livermore will be the lead constructing <br />agency. However, should that development not move forward and Pleasanton <br />approves the Staples Ranch development, Pleasanton could become the lead <br />constructing agency. Regardless of Livermore's development schedule/activity, <br />nothing in the agreement obligates Pleasanton to approve the Staples Ranch <br />development. <br />Assures that Vulcan Materials has continued access to its quarry property and <br />operations during and after the EI Charro Road improvements are constructed. <br />Page 3 of 6 <br />
