THE CITY OF j~L£~S~4NTONo CITY COUNCIL AGENDA REPORT 8 September 18, 2007 Public Works Department TITLE: CONSIDER A PREDEVELOPMENT AND COOPERATION AGREEMENT BETWEEN THE CITIES OF LIVERMORE, PLEASANTON, THE COUNTY ALAMEDA, THE ALAMEDA COUNTY SURPLUS PROPERTY AUTHORITY AND CALMAT CO., DBA VULCAN MATERIALS AND A COST SHARING AGREEMENT BETWEEN THE CITIES OF LIVERMORE, PLEASANTON AND THE ALAMEDA COUNTY SURPLUS PROPERTY AUTHORITY CONCERNING THE STAPLES RANCH PROPERTY SUMMARY Attached is a Cost Sharing Agreement between the Cities of Livermore, Pleasanton, and the Alameda County Surplus Authority, and aPre-Development and Cooperation Agreement between the Cities of Livermore, and Pleasanton, the County of Alameda, Alameda County Surplus Property Authority (SPA), and Vulcan Materials (Vulcan), which operates the quarries south of the Staples Ranch property. Each of these parties have economic, regulatory or ownership interests in land within, or adjacent to, Staples Ranch and will therefore share, to various degrees, in the benefits and responsibilities of constructing and maintaining public improvements in the area. The agreements establish financial responsibility, design responsibility and parameters, construction timing and long term rights as they relate to the design and construction of EI Charro Road and mitigation of storm water issues. The agreements do not obligate Pleasanton to approve improvements proposed for the Staples Ranch development or alter financial assumptions made in the Staples Ranch MOU, but rather, establish the scope of improvements required and the method of payment in the event development is approved. RECOMMENDATION Staff recommends that the City Council approve the attached two resolutions authorizing the City Manager to execute the agreements. FINANCIAL STATEMENT Approval of the agreements establish financial obligations for roadway and storm water improvements included in the Staples Ranch MOU including a $1 million reimbursement to the City of Pleasanton from the City of Livermore towards the I-580/ EI Charro Road interchange improvements.
