3 <br />THE CITY OF <br />-. ~. .~. ~ <br />L£~S~4NTONo CITY COUNCIL AGENDA REPORT <br />September 18, 2007 <br />Planning and Community Development <br />TITLE: PUD-99-1-4M, JEREMY AND JOSIE BARNISH - CONSIDER AN <br />APPLICATION FOR A MAJOR MODIFICATION TO AN APPROVED <br />PUD DEVELOPMENT PLAN TO ALLOW AN EXISTING SOLID FENCE <br />TO REMAIN, WHERE OPEN FENCING IS REQUIRED, ALONG A <br />PORTION OF THE REAR AND SIDE PROPERTY LINE OF THE <br />PROPERTY LOCATED AT 4526 RIVER ROCK HILL ROAD AND TO <br />MODIFY CONDITION OF APPROVAL N0.6 OF ORDINANCE NO. 1918 <br />(PUD-99-01-3M), ADOPTED ON JUNE 21, 2005, SUCH THAT <br />REQUESTS FOR SOLID FENCING MAY BE APPROVED BY THE <br />ZONING ADMINISTRATOR. <br />PROPERTY OWNERS: Jeremy and Josie Barnish <br />GENERAL PLAN: Rural Density Residential and Low Density Residential <br />ZONING: PUD-RDR/LDR (Planned Unit Development - Rural Density <br />Residential/Low Density Residential) District <br />SUMMARY <br />The applicants propose to retain an existing solid fence on their property in the Lemoine <br />Ranch development. The solid fence is located where open fencing is required per the <br />PUD. Some solid privacy fencing is allowed in this subdivision. Staff believes that the <br />proposed fence is not highly visible and will have only a minimal impact on the rural <br />character of the west side of Foothill Road. This application also includes a request to <br />modify the PUD conditions of approval such that the Zoning Administrator may approve <br />similar solid fencing requests in this subdivision. Currently the PUD requires all solid <br />fencing requests to be reviewed by the Planning Commission and City Council through <br />a PUD Major Modification process. Staff believes all outstanding issues have been <br />addressed. <br />PLANNING COMMISSION RECOMMENDATION <br />The Planning Commission recommended approval of the application (5-0 vote), subject <br />to the conditions of approval recommended by staff. <br />
