"Environmental Findings and Statement of Overriding Considerations," <br />attached hereto as Exhibit A and incorporated herein by this reference; <br />and <br />2. That those remaining unavoidable significant adverse effects identified in <br />that document have been found acceptable in that the social, economic, <br />and environmental/land use benefits to the proposed project as indicated <br />in the Environmental Impact Report, staff reports, and testimony at public <br />hearings outweigh the remaining unavoidable adverse impacts, as <br />indicated in the "Statement of Overriding Considerations" in the document <br />entitled ""Environmental Findings and Statement of Overriding <br />Considerations," attached hereto as Exhibit A" and incorporated herein by <br />this reference. <br />SECTION 2. Approves Case PUD 33, the application of James Tong, Charter <br />Properties, for Planned Unit Development (PUD) development plan approval to <br />create 51 custom home sites and to designate the remaining area for permanent <br />open space, on a 562-acre site located at 1400 Hearst Drive, near the present <br />terminus of Hearst Drive, to the south of the Vintage Hills and the Grey Eagle <br />Estates, and to the east of Kottinger Ranch, subject to the conditions shown on <br />Exhibit B, attached here and incorporated herein by this reference. <br />SECTION 3. The City staff is directed to cause a Notice of Determination to be <br />filed pursuant to Section 5.4(g) of Resolution No. 77-66. <br />SECTION 4. A summary of this ordinance shall be published once within fifteen <br />(15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall <br />be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days <br />after its adoption <br />SECTION 5. This ordinance shall be effective thirty (30) days after its passage <br />and adoption. <br />ADOPTED at a regular meeting of the City Council of the City of Pleasanton on <br />September 18, 2007. <br />The foregoing Ordinance was introduced at a regular meeting of the City Council <br />of the City of Pleasanton on September 4, 2007 by the following vote: <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br />2 <br />
