PUD-33 <br />Oak Grove Development/Lin Property <br />Exhibit "C-1", PUD Development Plan Findings <br />September 4, 2007 <br />If the Planning Commission concludes that the proposed PUD development plan <br />conforms to the purposes of the PUD District, it must make the following findings. <br />1. Whether the proposed development plan is in the best interests of the <br />public health, safety, and general welfare: <br />• The proposed project as designed and conditioned meets all applicable City <br />standards concerning public health, safety, and welfare, e.g., vehicle access, <br />geologic hazards (new development not within a special studies zone), and <br />flood hazards. <br />• Full public streets and water, storm, and sanitary sewer lines are present to <br />serve the proposed lots on this site. The City water tank to be constructed <br />with this proposal will provide aback-up source of domestic water for nearby <br />neighborhoods. <br />• Stormwater runoff will be pretreated in on-site bio-retention swales and ponds <br />before discharge to the City's storm lines. <br />• Sensitive habitat areas will be preserved in conformance to Federal and <br />California State standards. <br />• A Wildland Fire buffer area will surround the lots and streets of this <br />development to protect the homes and residents from fire hazards. <br />• The open space area -estimated to be about 497 acres of land -will be <br />dedicated to the City of Pleasanton, or other public entity, as permanent open <br />space in perpetuity with the first final subdivision map. The open space area <br />will contain wildlife habitat preservation areas; will include a system of <br />regional and local public trails including a trail staging area; will include tree <br />reforestation of the slopes facing the existing developments to the north; and <br />will include a fire break areas and detention/settlement ponds serving the <br />proposed development. <br />• A conservation easement will be granted over the open space area to a third <br />party authorized to hold such easements to provide inspection and oversight <br />of the open space area. <br />• Local and regional public trails and a trail staging area will be constructed in <br />the open space before the sale of the fifth lot. <br />Page 1 of 6 <br />
