would pay an in-lieu fee to City's Low-Income Housing Fund if the units are not provided <br />within five years of the first final subdivision map. <br />Development Agreement <br />The Development Agreement would vest the entitlement set forth by the PUD <br />development plan and conditions of approval and would incorporate, where applicable, <br />the mitigation measures of the Environmental Impact Report. <br />IV. COMMENTS BY CITY COMMISSIONS AND COMMITTEES <br />Housing Commission <br />The Pleasanton Housing Commission heard the applicant's proposal at its public <br />hearing held on January 18, 2007. The public hearing minutes are attached as <br />Exhibit I-1. The Housing Commission voted to require that the 20 affordable units be <br />produced within five years starting from approval of the final subdivision map and that <br />the developer provide the City with an annual progress report. <br />Parks And Recreation Commission/Trails Ad-Hoc Committee Work Session <br />The Parks and Recreation Commission and the Trails Ad-Hoc Committee held a public <br />work session on January 11, 2007 to discuss and make recommendations on the open <br />space areas of the Oak Grove development: ownership, type of facilities, and timing. <br />Minutes of the meeting are attached. <br />The Committee and the Commission supported City ownership of the entire open space <br />area upon recordation of the first subdivision map, supported installation of local and <br />regional trails and a trails staging area before the sale of the fifth lot, and found that a <br />neighborhood park would not have to be provided with this development given the open <br />space dedication, provision of trails, and lack of a flat, five-acre site. <br />Planning Commission <br />The Planning Commission reviewed the Oak Grove Draft EIR at two publicly noticed <br />work sessions held on July 12, 2006 and August 23, 2006. Minutes of the work <br />sessions are attached and the comments are analyzed in the Final EIR. The Planning <br />Commission then reviewed the entire Oak Grove development -Final EIR, PUD <br />Development Plan, and Development Agreement at two public hearings held on June <br />13, 2007 and June 27, 2007. Minutes of the hearings are attached. <br />As a result of the June 13, 2007 Planning Commission hearing, there were various <br />issues that were raised about which the Planning Commission requested clarification <br />and/or additional information. The following issues were raised by the Planning <br />Commission based upon the public opposition to the proposal: <br />• The EIR process and the adequacy of the studies conducted by the City's <br />environmental consultant; <br />• The visual analysis including ridge top development and graphic representation; <br />• Fire response and protection issues, including adequacy of site ingress/egress; <br />• Home size and Floor Area Ratio; <br />Page 8 of 27 <br />
