~3 <br />THE CITY OP <br />--~ ~~i -~- "" CITY COUNCIL AGENDA REPORT <br />j~L£~S~NTONa <br />September 4, 2007 <br />Public Works Department <br />TITLE: DECLARATION THAT A PORTION OF PARCEL C, TRACT 7374 IS <br />SURPLUS, AND AUTHORIZING THE CITY MANAGER TO QUITCLAIM <br />THE CITY'S INTEREST THEREIN TO THE ADJACENT PROPERTY <br />OWNERS <br />SUMMARY <br />K B Homes developed Tract 7374, Canyon Oaks, a 128-lot, single-family detached, <br />residential subdivision west of Valley Avenue near Case Avenue. Part of the <br />development required K B Homes to dedicate to the City in fee title a buffer area (Parcel <br />C on the Final Map) between the subdivision lots and the drainage channel that runs <br />along Valley Avenue and along the Alameda County Transportation Corridor. One of the <br />property owners adjacent to the buffer area is asking the City to deed to them a portion <br />of that property. The property owners would relocate the public utilities currently on the <br />portion to be deeded to them to another area of Parcel C and then use the deeded area <br />to expand their side yard. The area that the property owners are asking to be deeded is <br />approximately 3330 square feet. The City has no need for this property and it can be <br />declared surplus. The cost to relocate the public utilities far outweigh the value of the <br />land. The Homeowners' Association that has the responsibility to maintain Parcel C has <br />expressed no objection to the City's transferring this property as described above. <br />RECOMMENDATION <br />1. Declare as surplus an approximately 3330 square foot portion of Parcel C of Tract <br />7374 and authorize the City Manager to sign a quitclaim deed quitclaiming the <br />City's interest in that property to the adjacent property owner. <br />2. Authorize the City Clerk to record the quitclaim deed. <br />FINANCIAL STATEMENT <br />There will be no fiscal impact to the City by declaring this portion of the buffer area as <br />surplus and quitclaiming it to the adjacent property owner. The area is not landscaped <br />and currently the property is being maintained (weed abatement only) by the <br />Homeowners' Association. <br />
