the front yard landscaping (see Attachment 2). These bio swale areas have been shown on the Final Map to prevent future improvements or changes within these areas. Tree Preservation The tree report conducted by HortScience identified two Modesto Ash trees and one Coast Live Oak tree for preservation. The two Modesto Ash trees are within the St. John Street right-of-way and the Coast Live Oak tree is within the Peter's Avenue right-of- way. An additional two trees have been identified in the project's conditions of approval for preservation. One of these trees is the Oak tree on the property line at 730 Peter's Avenue and the second tree is amulti-branch Coast Live Oak tree on the western tract boundary. The proposed retaining wall at the western tract boundary will be adjusted inside lot 4 for the purpose of preserving this multi-branch -Coast Live Oak Tree. The owner of lot 4 and the maintenance association will be responsible for maintaining the area between the retaining wall and tract boundary. Discretion to Deny the Final Map A local agency may not disapprove a Final Map if it has previously approved a tentative map for the proposed subdivision, and if it finds that the Final Map is in substantial compliance with the previously approved tentative map (Government Code, section 66474.1). A Final Map shall be disapproved only for failure to meet conditions that were applicable at the time the tentative map was approved. If the Final Map is disapproved, there must be a finding identifying the conditions, which were not met (Government Code, section 66473). The approval of a Final Map, when the Final Map substantially complies with the previously approved tentative map, is a mandatory, ministerial act. Staff has reviewed the conditions of approval of the tentative map, and finds that all conditions have been satisfied and that the Final Map complies with the tentative map.
