The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. Based on the business description, the contractor business would be compatible with other businesses in the same Business Park. In addition, traffic generated from the business during the regular business hours would be unnoticeable as the majority of the work force report directly to the job sites. Conditions of approval prohibit the business from rinsing off construction vehicles, equipment, etc. at the subject site. Therefore, this finding can be made. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The use of the property is for a business office. With the proposed conditions, the contractor's office would comply with all relevant sections of the zoning ordinance. Granting a conditional use permit to the applicant would be consistent with the City's ability to regulate zoning as listed in the Municipal Code. Therefore, the third finding can be made. WHEREAS, the Planning Commission determined that the proposed conditional use would be compatible with the existing uses in the area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-193, the application of Tucknott Electric for a conditional use permit to operate a construction and construction-related business office at 1032 Serpentine Lane, Suite 103, subject to the conditions shown in Exhibit B, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
