<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-36 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />JEREMY AND JOSIE BARNISH FOR A MAJOR MODIFICATION, <br />AS FILED UNDER CASE PUD-99-01-04M <br /> <br />WHEREAS, Jeremy and Josie Barnish has applied for a major modification to an <br />approved PUD development plan to allow an existing solid fence to <br />remain, where open fencing is required, along a portion of the rear and <br />side property lines of the property located at 4526 River Rock Hill Road <br />and to modify Condition No. 6 of Ordinance No. 1918 (PUD-99-01-03M), <br />adopted on June 21, 2005, such that requests for solid fencing may be <br />approved by the Zoning Administrator; and <br /> <br />WHEREAS, zoning for the property is PUD-RDR/LDR (Planned Unit Development – <br />Rural Density Residential/Low Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 8, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA), Class 3 exemption <br />Section 15303; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed modification <br />would be consistent with other recently approved projects in the area and <br />would not alter the natural topographical features of the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case PUD-99-01-04M, the application of <br />Jeremy and Josie Barnish for a major modification to an approved PUD <br />development plan to allow an existing solid fence to remain, where open <br />fencing is required, along a portion of the rear and side property lines of <br />the property located at 4526 River Rock Hill Road and to modify <br />Condition No. 6 of Ordinance No. 1918 (PUD-99-01-03M), adopted on <br />June 21, 2005, such that requests for solid fencing may be approved by <br />the Zoning Administrator, subject to the conditions shown in Exhibit B, <br />attached hereto and made part of this case by reference. <br /> <br /> <br />
