<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-35 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF MICHAEL <br />CAREY AND STEVE MAESTAS FOR PLANNED UNIT DEVELOPMENT REZONING <br />AND DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-55 <br /> <br />WHEREAS, Michael Carey and Steve Maestas have applied for Planning Unit <br />Development approval to: (1) rezone an approximately 0.24-acre parcel <br />from RM-15 (Multiple-Family Residential) District and Core Area Overlay <br />District to PUD-HDR (Planned Unit Development – High Density <br />Residential) District and Core Area Overlay District; and (2) demolish two <br />existing residential units, renovate one existing residential unit, and <br />construct four new single-family homes for a total of five residential units <br />at the property located at 225 West Angela Street; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 11, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS,an Environmental Impact Report (EIR) for the Downtown Specific Plan <br /> <br />was approved by the City Council on March 5, 2005, and the EIR <br />anticipated that a high-density residential project, such as that proposed, <br />would be located on the project site, and <br /> <br />WHEREAS, the Planning Commission determined that the proposed rezoning and <br />development plan are appropriate for the site; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The plan is in the best interests of the public health, safety, and <br />general welfare. <br /> <br />The proposed development, as conditioned, meets all applicable City <br />standards concerning public health, safety, and welfare including vehicle <br />access and geologic and flood hazards. The project developer will install <br />all on-site infrastructure with connections to the municipal systems in order <br />to serve the site. Adequate storm drain, sanitary sewer, and water service <br />utilities are present near the development and are sufficient to serve the <br />new buildings. Public street access is provided to all structures for police, <br />fire, and other emergency response vehicles. The buildings are designed <br />to meet the requirements of the Building Code, Fire Code, and other <br />applicable City codes. Therefore, this finding can be made. <br /> <br />
