<br /> <br /> <br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-31 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF STANLEY CENTER, LLC <br />FOR DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PDR-563 <br /> <br />WHEREAS, Stanley Center, LLC has applied for design review approval to construct <br />an approximately 31,180-square-foot retail building, an approximately <br />3,940-square-foot retail pad, parking stalls, and landscaping at the <br />property located at 3595 Utah Street; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - <br />Commercial) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 27, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, in urbanized areas, the construction of a new commercial building of <br />10,000 square feet or less in area is categorically exempt (Section 15303, <br />Class 3) from the requirements of the California Environmental Quality Act <br />(CEQA); furthermore, in-fill development projects on sites of five acres or <br />less that have no habitat for endangered, rare, or threatened species, that <br />can be adequately served by all required utilities and public services, that <br />are consistent with the General Plan and zoning regulations, and that <br />would have no significant effects on traffic, noise, air quality, or water <br />quality (Class 32) are also categorically exempt from CEQA; and this <br />project meets the conditions of the Class 3 and 32 exemptions; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case PDR-563, the application of Stanley Center, LLC for <br />design review approval to construct an approximately 31,180-square-foot <br />retail building, an approximately 3,940-square-foot retail pad, parking <br />stalls, and landscaping at the property located at 3595 Utah Street, <br />subject to the conditions shown in Exhibit B, attached hereto and made <br />part of this case by reference. <br />1 <br /> <br /> <br />
