CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-334 <br /> <br /> RESOLUTION VACATING A TEN FOOT WIDE <br /> PUBLIC SERVICE EASEMENT OVER LOTS 28, 29, <br /> AND 32 OF TRACT 5188 AND LOT LINE <br /> ADJUSTMENT 87-4 <br /> <br />WHEREAS, on July 19, 1988, the City Council received a <br /> report (SR 88:351) recommending vacation of a <br /> public service easement over Lots 28, 19 and 32 of <br /> Tract 5188 and Lot Line Adjustment 87-4, more <br /> particularly described on Exhibit "A" attached <br /> hereto and incorporated herein by this reference; <br /> and <br /> <br />WHEREAS, due to a reconfiguration of Lots 28 and 29, they <br /> are now serviced from the sewer main in Grey Fox <br /> Circle and the public service easement is not <br /> required and has not been used since dedication; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> that the public service easement is not required <br /> for public utility purposes pursuant to Section <br /> 8335 of the Streets and Highways Code, the public <br /> service easement described in Exhibit "A" is <br /> hereby vacated. <br /> <br />Section 2: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office <br /> of the Alameda County Recorder. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the public service easement vacated no <br /> longer constitutes a public service easement. <br /> <br />Section 4: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
