Section 22. Resiqnation, Reinstatement and Layoff <br /> <br />22.1 Automatic Resiqnation <br /> <br /> Failure to return at the expiration of a leave of absence <br /> or being absent without leave shall be considered an <br /> automatic resignation. Such a resignation may be <br /> rescinded by the City Manager if the employee submits <br /> satisfactory reasons for his/her absence within three (3) <br /> calendar days of the date his/her resignation was <br /> effected. <br /> <br />22.2 Voluntary Resignation <br /> <br /> An employee may resign in good standing by submitting to <br /> the Fire Chief and Personnel Officer a written <br /> resignation stating the reasons therefor and effective <br /> date thereof at least two (2) weeks prior thereto. <br /> <br /> A statement as to the resigned employee's performance <br /> shall be forwarded to the Personnel Officer by the Fire <br /> Chief. <br /> <br />22.3 Reinstatement <br /> <br /> With the approval of the Personnel Officer, an employee <br /> who has resigned in good standing may be reinstated <br /> within two (2) years of the effective date of resignation <br /> to a vacant position in the same or comparable class. <br /> Upon reinstatement, the employee, for all purposes, shall <br /> be considered as though he had received a new <br /> appointment. <br /> <br />22.4 Layoff <br /> <br /> The Appointing Authority may lay off an employee because <br /> of material changes in duties, organization or shortage <br /> of work or funds. <br /> <br /> The employee having the least length of total continuous <br /> service with the department in classification in which <br /> the Appointing Authority is laying off, shall be laid off <br /> first. <br /> <br /> - 31 - <br /> <br /> <br />
