CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION N0. 88-323 <br /> <br /> RESOLUTION DENYING THE APPEAL OF THE CITY <br /> COUNCIL OF THE DECISION OF THE DESIGN <br /> REVIEW BOARD APPROVING THE APPLICATION OF <br /> MCDONALD'S CORPORATION FOR DESIGN <br /> APPROVAL TO CONSTRUCT A TANDEM DRIVE- <br /> THROUGH WINDOW ADDITION TO AN EXISTING <br /> RESTAURANT LOCATED AT 6800 SANTA RITA <br /> ROAD (AP-88-12/Z-88/149) <br /> <br />WHEREAS, at its meeting of May 25, 1988, the Design Review <br /> Board approved McDonald's application for design <br /> approval to construct a tandem drive-through window <br /> addition to an existing restaurant located at 6800 <br /> Santa Rita Road (Z-88-149); and <br /> <br />WHEREAS, this decision was appealed by the City Council so <br /> they could review the application totally; and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on July 5, 1988 at which time the applicant and any <br /> other member of the public was offered an <br /> opportunity to present evidence regarding this <br /> appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the City Council (AP-88-12) <br /> and therefore approves the Design Review Board <br /> approval of case Z-88-149, the application of <br /> McDonald's Corporation for design review approval <br /> to construct a tandem drive-through window addition <br /> to an existing restaurant located at 6800 Santa <br /> Rita Road, subject to the following conditions: <br /> <br /> 1. That the drive-through window addition shall <br /> conform substantially to the plans and <br /> elevations, Exhibit A (dated April 20, 1988), <br /> on file with the Planning Department. <br /> <br /> 2. That the applicant shall apply for and receive <br /> all applicable City permits for the addition <br /> prior to its construction. <br /> <br /> 3. City Council accepts the applicant's waiver of <br /> the inclusion of the appraised value of the <br /> drive-through window and associated <br /> improvements in any condemnation initiated by <br /> <br /> <br />
