currently owned by the City of Pleasanton adjacent <br /> to the DSRSD Regional Sewer Treatment Plant. <br /> <br />Section 3: Special Conditions of Growth Manaqement Approval <br /> <br /> In addition to development fees in effect at the <br /> time each building permit is issued, developers <br /> shall pay growth management fees of $750 per unit <br /> to offset the cumulative cost of capital facilities <br /> made necessary by ongoing residential development. <br /> <br />Section 4: Effect of Approval <br /> <br /> a. The effect of these growth management <br /> approvals shall be to authorize development, <br /> building and occupancy of the approved units <br /> and provide for the lapsing of approvals in <br /> accordance with Chapter 17.36 of the <br /> Pleasanton Municipal Code as worded on the <br /> effective date of Ordinance 1336 (attached <br /> hereto) and the additional conditions spelled <br /> out in this resolution. <br /> <br /> b. The City grants these growth management <br /> approvals with the expectation and <br /> understanding that the owners of lands upon <br /> which approval is granted will rely upon their <br /> continuing validity. However, the City cannot <br /> guarantee that actions beyond reasonable <br /> control of the City will not interfere with <br /> development of the subject parcels. <br /> <br /> c. The City will use its best efforts to reserve <br /> sewage capacity sufficient for outstanding <br /> valid sewer permits, but this resolution does <br /> not guarantee the availability of sufficient <br /> sewage treatment capacity to serve the <br /> project. Building permits may be withheld if <br /> sewage treatment capacity is determined by the <br /> City, the Dublin San Ramon Services District <br /> or The Regional Water Quality Control Board <br /> not to be available at the time developer <br /> applies for a building permit. In the event <br /> sewage treatment capacity is not available to <br /> enable developer to meet the development <br /> schedule approved by the resolution, the City <br /> will enact amendments to this resolution which <br /> will, as so far as is feasible, carry out the <br /> intent of this resolution given the <br /> availability of sewage'treatment capacity. <br /> <br />Section 5: Nothing herein shall lessen any obligation of <br /> developer required as a condition of any other <br /> approvals granted by the City. <br /> <br /> <br />
